Since her call to the bar in 1998, Rastin Law’s Associate Lawyer Anita Wong is driven to assist clients in the area of Civil Litigation. Her focus and dedication to “fight for right” is what motivates her to consistently argue and win cases at all levels of court.

Notable Decisions

  • Henwood v. Coburn, 2007
    Anita acted on behalf of the respondent in this motor vehicle accident case. The appeal was made by the car rental company from the summary judgment granted to renter for damages for personal injury arising from the negligent driving of an unauthorized driver who took control of the wheel of a rental vehicle.  The appeal looked at negligence and vicarious liability of a driver operating a vehicle without consent from the owner. Appeal granted and summary judgment was set aside.
  • Howell v. Yourk, 2012
    Anita acted on behalf of the Plaintiff. The decision was made on costs following a 13 day jury trial. Plaintiff was a pedestrian who had just exited his car when he was struck by the Defendant’s car. Plaintiff was awarded damages totalling $480,000.00 and jury verdict exceeded amounts set out in the Plaintiff’s offer to settle.  Defendants were ordered to pay the Plaintiff his costs in the amount of $330,000.00.
  • Ivens v. Lesperance, 2012
    Anita acted on behalf of the Plaintiff. The decision was made on costs following a 13 day jury trial. Plaintiff was a pedestrian who had just exited his car when he was struck by the Defendant’s car.   • McGowan v. Rainmaker Estates Inc., 2008
    Anita acted on behalf of the Defendant. The decision was made following 19 day trial over property dispute. The Plaintiff claimed possessory title over lands titled to the Defendant. The land in question was a creek running through the land.  Evidence at trial included experts and non-experts, surveyors, lawyers, and lay witnesses who testified as to historical use and treatment of the land in question.  Plaintiff’s claim dismissed and boundary line found to be where properties adjoin as described in their respective deeds.
  • Turcotte v. Lewis et al, 2018
    Anita acted on behalf of the Plaintiffs. The appeal by Plaintiffs from summary judgment granted to Defendants Bar, Bouncer, Bus Company and Bus driver.  The main Plaintiff suffered a traumatic head injury when he was assaulted by two individual Defendants after leaving a bus which was chartered to bring guests to and from a resort bar in Muskoka.  The Plaintiffs’ claims were for damages for personal injury.  Appeal allowed as the Motions judge failed to fully articulate and apply the standard of care regarding negligence.
  • Wright v. Sajnovic, 2008
    Dispute between neighboring land owners, one a farm, ie. Stanrika Farms, a turkey farm in the Orillia area, and the other an individual land owner who had purchased property near the farm and then complained of farm odor, flies, and noise. The board found in favor of the farmer, ruling that the applicant had not established that he was being substantially affected by disturbances from the turkey operation.
  • Alcamo v. Valente, 2004
    Anita acted on behalf of the Plaintiffs. The case was made over a multi-day trial before a Jury. The issue was on whether or not the Plaintiff’s failure to wear a seat belt should be put before a jury for consideration of contributory negligence despite no expert evidence put forward on this issue. We were able to obtain a favourable verdict for the Plaintiff.
