Richard Halpern

Senior Counsel & Lawyer

As a senior lawyer focusing on medical negligence cases, Richard Halpern’s specialty involves those injured at or around the time of birth. Over the past three decades, he has earned a national reputation in this area, guided by his detailed understanding of medical issues related to birth injury cases. Drawing on this insight, he is able to provide guidance and counsel to families contemplating a medical negligence lawsuit, no matter what the circumstances.

Richard has lectured and written numerous papers on obstetrical issues and the cause of newborn injury, as well as providing insights into legal and trial strategies for malpractice cases. He has given presentations to more than 70 professional groups in the last decade, with a recent paper titled Birth Trauma Litigation: Proving the Cause of Newborn Neurologic Injury.

In 2015, Richard’s peers at the Ontario Bar Association honoured him with the Award for Distinguished Service to the legal profession. Other recognition bestowed on him includes being listed in The Best Lawyers™ in Canada, along with The Canadian Legal Lexpert® Directory.

In his hundreds of medical malpractice cases, Richard has achieved significant settlements, some exceeding $10 million, though he cautions that past results are not necessarily indicative of future outcomes.

Richard is a proud member of The Holland Group. Led by former Associate Chief Justice of Ontario Coulter Osborne, it promotes reforms in medical malpractice cases, aiming to increase access to justice while bringing about timely and equitable resolutions. He is also a member of a bench and bar committee created by the Ontario Court of Justice, studying reforms to improve how justice in the province is meted out.

Richard’s other accomplishments include being a past president of the Ontario Trial Lawyers Association and a past member of the Judicial Advisory Committee on Judicial Appointments (GTA). This distinguished group was charged with evaluating candidates for the Superior Court of Justice, the Ontario Court of Appeal, the Federal Court and the Federal Court of Appeal.

After earning a Bachelor of Arts degree (BA) and Bachelor of Laws degree (LLB), Richard was awarded a Master’s Degree in Law (LLM) in Civil Litigation by Osgoode Hall Law School. He is a member of the Advocates’ Society, the Ontario Trial Lawyers’ Association, the Ontario Bar Association and the American Association of Justice.
